    California Reaffirmed State Protections for Emotional Support Animals

    California's Civil Rights Department stated that state protections for support-animal users remain in place despite HUD's changed federal enforcement approach.

    Support Animals

    CRD's July 20 legal alert stated that FEHA and Unruh protections remain unaffected by HUD's changed federal approach. California law may protect emotional support animals that are not task-trained, subject to applicable requirements and defenses.

    Accessible Parking

    A June 2026 CRD settlement involved repeated requests for a closer parking space for children with physical disabilities. CRD stated that failure to engage with a tenant's accommodation request can be discrimination. The settlement included relief but was not a court precedent.

    Group and Recovery Homes

    A June 2026 California legal alert stated that FEHA group-home protections remain after a 2025 Ninth Circuit zoning decision. Whether a particular home, local rule, or requested zoning accommodation is protected remains fact-specific.
